Common questions

I was just served with a lawsuit. What should I do?

Do not ignore it. In New York you generally have a short, fixed period to respond, and missing the deadline can result in a default judgment against you. Contact an attorney as soon as possible and bring the papers you received.

Is there a deadline to file a claim?

Yes. Every type of claim has a statute of limitations, and the time limits vary by claim. Some deadlines, especially for claims against government agencies, are very short. It is best to speak with an attorney promptly so your rights are protected.

Will my case go to trial?

Most civil cases are resolved before trial through settlement or motion practice. Mr. Vitale prepares every case as if it may be tried, which puts clients in a stronger position to negotiate.
