Common questions
What is probate?
Probate is the court process that confirms a will is valid and gives the executor legal authority to act for the estate. In New York, probate is handled by the Surrogate's Court in the county where the person lived.
How long does probate take?
It depends on the size and complexity of the estate and whether anyone objects. A simple estate generally takes six months or longer. Contested or complicated estates can take significantly longer.
What if there is no will?
When someone dies without a will, a family member usually asks the Surrogate's Court to be appointed administrator. The estate is then distributed according to New York's intestacy laws.
